Abstract/Summary:
The Quebec Government reformed in June 2017 the legal framework applicable to wetlands and bodies of water in order to modernize the measures that ensure their conservation. The Act respecting the conservation of wetlands and bodies of water amended various Acts to reflect different components of the reform. More specifically, the Act to affirm the collective nature of water resources and provide for increased water resource protection is amended to recognize the ecological functions of wetlands and bodies of water, and to make regional county municipalities responsible for developing and implementing a regional wetlands and bodies of water plan in their respective territories. That Act is further amended to grant the Minister the power to develop and implement programs to promote the restoration and creation of wetlands and bodies of water. The Natural Heritage Conservation Act is amended to facilitate the conservation of certain wetlands and bodies of water through their designation and the establishment of their boundaries on a plan. The Environment Quality Act is also amended to set out special requirements for documenting authorization applications for projects in wetlands and bodies of water. The new provisions are intended to prevent the loss of wetlands and bodies of water and to foster the development of projects with minimal impacts on those environments. Compensation measures, generally in the form of a financial contribution, are also provided for cases where it is impossible to avoid adverse effects on the ecological functions of wetlands and bodies of water.
